1. About This Agreement

These terms apply when you use our website or hire us for cybersecurity services. By using our site or engaging our services, you agree to these terms. If you're agreeing on behalf of a company, you're confirming you have authority to bind that company.

2. Who We Are

Trace Veil Forensics is a registered cybersecurity consulting startup operating from Kenya. We provide security assessments, vulnerability scanning, incident response, digital forensics, IT solutions, and training services - all delivered remotely.

3. Scope of Services

We provide consulting services, not products. This means:

• We give advice and recommendations based on our expertise
• We don't guarantee specific security outcomes
• You decide whether to implement our recommendations
• Final security decisions remain your responsibility

4. Your Responsibilities

When working with us, you agree to:

• Provide accurate information about your systems and needs
• Give us reasonable access to complete our work
• Keep any credentials or access codes secure
• Use our services for legitimate business purposes only
• Not test our systems without explicit written permission

5. Pricing and Payment

• We quote prices before starting any paid work
• You approve the quote before we begin
• Payment is due within 14 days of invoice date
• For ongoing services, we bill monthly
• We reserve the right to pause work if invoices are overdue

6. Confidentiality

What we keep confidential: Information you share during assessments, your security posture data, findings and reports, and any information marked confidential.

What you keep confidential: Our methodologies, tools, and proprietary techniques.

This obligation continues for 2 years after our engagement ends.

7. Intellectual Property

• Our content: Everything on our website (except your data) belongs to us
• Your data: Remains yours
• Work product: Reports and deliverables we create become yours after full payment
• General knowledge: We may use knowledge gained (without identifying you) to improve our services

8. Our Liability - Be Clear Here

• Maximum liability: The amount you paid us for the specific engagement
• We don't cover: Lost profits, business interruption, reputational damage, or indirect damages
• Security is never guaranteed: Even the best security can be breached
• Your systems: You implement recommendations at your own risk

9. Your Liability to Us

You agree to compensate us for any claims arising from:

• Your use of our services for illegal purposes
• Breach of these terms by you or your team
• Third-party claims related to your business

10. Service Availability

• We operate remotely and flexibly
• Scheduled work proceeds during agreed hours
• For urgent incidents, we respond within hours, not days
• We may need to reschedule due to unforeseen circumstances

11. Ending the Engagement

You can end anytime: Give us 14 days notice. You'll pay for work completed.

We can end if: You violate these terms, don't pay, or ask us to do something illegal.

After ending: We return or securely delete your data within 30 days, except as required by law.

12. Disputes

First, we talk it out. If that doesn't work, disputes go to mediation. If still unresolved, binding arbitration. These terms follow Kenyan law.

13. Things Beyond Our Control

We're not responsible for failures caused by: natural disasters, war, government actions, internet outages, or third-party service failures.

14. Changes to These Terms

We may update these terms. Changes apply immediately to new clients. For existing engagements, we give 14 days notice for material changes.
